These Terms and Conditions (“Terms”) govern your use of bikeparkatuitsig.co.za (the “Website”) and your purchase of products and services from The Bike Park at Constantia Uitsig (Pitkin Cycles), a company registered in South Africa (Registration No. 2010/160349/23), with its principal place of business at Constantia Uitsig, Spaanschemat River Road, Constantia, Western Cape, 7806.

By using the Website, placing an order online and purchasing in-store, you agree to be bound by these Terms. If you do not agree, please do not use the Website or our services.

2. Definitions

“Products” means bicycles, parts, accessories, and other goods sold via the Website or in-store.
“Services” means repairs, servicing, fittings, or other work performed on bicycles.
“Customer” / “you” means any person using the Website, purchasing Products.

3. Online Orders

3.1 Placing an Order

An order placed through the Website is an offer to purchase, which we may accept or decline (e.g. due to stock unavailability, pricing errors, or suspected fraud). A contract is only formed once we send you an order confirmation.

Some products or services may be sold exclusively through our website and may be available in limited quantities. These items are subject to return or exchange only in line with our Return Policy.

Some product colours may differ from online pictures to in person products.

We reserve the right to limit sales of any product or service to a particular person, region, or jurisdiction, at our discretion and on a case-by-case basis, as well as to limit quantities available. Product descriptions and pricing may change at any time without notice, and we may discontinue any product at our sole discretion.

We don’t guarantee that any product, service, information, or other material you purchase or obtain from us will meet your expectations, or that any errors will be corrected.

 

3.2 Pricing and Availability

All prices are listed in South African Rand (ZAR) and include VAT unless stated otherwise.
We take reasonable care to ensure prices and stock levels are accurate, but errors may occur. If a Product is listed at an incorrect price due to a genuine error, we reserve the right to cancel the order and refund any amount paid.
Stock availability is not guaranteed until order confirmation.

3.3 Payment

Online payments are done using an independent, secure payment portal: Payfast. In store purchases may be made via card payments or EFT.

 

3.4 Delivery and Collection

Delivery times quoted are estimates only and are not guaranteed.
Risk in the Products passes to you on delivery or collection; ownership passes once payment has been received in full.
You are responsible for providing an accurate delivery address. Additional charges may apply for failed deliveries due to incorrect details.
Large items may require signature on delivery and inspection for transport damage before signing.

4. In-Store Purchases

Prices and stock in-store may differ from the Website.
Proof of purchase (receipt/invoice) is required for any return, exchange, or warranty claim.

5. Returns, Refunds, and Cancellations

5.1 Online Purchases

Products purchased online, you may cancel the transaction within 7 (seven) days of receiving the Products, without reason or penalty, except:

You are responsible for the direct cost of returning the goods;
Goods must be unopened, unused, and in original packaging with proof of purchase;
The right does not apply to Products made to your specifications (e.g. custom-built bikes) or that have been used/damaged beyond inspection.

5.2 General Returns

You may return Products:

That are defective or unsafe;
That do not match their description; or
If unopened, unused, and in original packaging with proof of purchase within 7 days from purchase date for a full refund.
Products excluded from general (non-defective) returns include: sale / clearance items, custom orders, worn/used components.

5.3 Refund Method

Approved refunds will be processed to the original payment method within 3 business days.

6. Warranties

6.1 Manufacturer Warranties

All warranty claims are subject to assessment and approval by the manufacturer or supplier. Bike Addict acts only as the facilitating retailer and cannot guarantee that any warranty claim will be approved. The decision to repair, replace, or reject a claim rests solely with the manufacturer.

The warranty applies only to the original owner and is non-transferable. Proof of purchase must be presented when submitting a claim.

The warranty does not cover labour charges for fitting or replacing parts. The client is responsible for shipping costs to and from Bike Addict. Clients are also welcome to take the product to their nearest local dealer for warranty purposes, should they prefer.

 

6.2 Exclusions

Warranties do not cover:

Normal wear and tear (tyres, brake pads, chains, cables, bearings, etc.);
Damage from misuse, accident, improper storage, or unauthorised modification;
Damage from use inconsistent with the bicycle’s intended purpose (e.g. off-road use of a road bike);
Corrosion or damage from inadequate maintenance.

7. Product Use and Safety

Bicycles are mechanical devices and cycling carries inherent risk of injury. It is your responsibility to ensure the bicycle is correctly fitted, maintained, and used with appropriate safety equipment (e.g. helmet).
Please read all safety and assembly instructions provided with your Product before use.
We recommend a professional safety check before first use of any bicycle not assembled by us.

8. Website Use

You must not use the Website for any unlawful purpose or in a way that could damage, disable, or impair it.
All content on the Website (text, images, logos, product descriptions) is owned by or licensed to us and may not be reproduced without permission.
We do not guarantee the Website will be uninterrupted or error-free.

9. Limitation of Liability

We are not liable for any indirect, incidental, or consequential loss arising from use of the Website, Products, or Services.
Our total liability in respect of any claim will not exceed the amount paid by you for the relevant Product or Service.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under the CPA, including liability for death, personal injury, or gross negligence.

10. Indemnity

You agree to indemnify The Bike Park at Constantia Uitsig (Pitkin Cycles), our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be held liable for any injury, loss, or claim, or for any direct, indirect, incidental, punitive, special, or consequential damages of any kind — including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages — whether arising in contract, tort (including negligence), strict liability, or otherwise, resulting from your use of the service or any products obtained through it, or from any other claim connected in any way to your use of the service or any product. This includes, but is not limited to, errors or omissions in any content, and any loss or damage of any kind incurred as a result of using the service or any content or product posted, transmitted, or otherwise made available through it, even where we have been advised of the possibility of such damages.

11. Privacy

Your personal information is collected and processed in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA).

13. Amendments

14. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the non-exclusive jurisdiction of the South African courts.
